Notes: third son of Thomas De Berkley, by his wife, dau. of William De Ferrers Earl of Derby. When the news reached Exeter that Bishop Walter Stapeldon had fallen a victim to the popular phrensy in London, the dean and chapter assembled to deliberate on a suitable successor. Their choice was unanimous in favour of their colleague James Berkeley. For the last eight years he had been also Archdeacon of Huntingdon, and was powerful by his family connections. The royal assent was given to the election on 12 Dec 1326, and six days later the King addressed a letter from Kenilworth to Pope John XXII, extolling the elect for pre-eminence of merit, noble descent, learning, and circumspection, and praying that no obstacle might be opposed to his consecration. To the cardinals individually the King on the same day addressed letters to the same purpose (Rymer's 'Foedera,' tom. .iv. p. 240). The primate Walter Reynolds consecrated the elect, at Canterbury, on Midlent Sunday, 22 Mar following, assisted by the Bishops of Rochester and Chichester; or perhaps on 15 Mar, as the 'Chronicon' of Exeter asserts. But, after the consecration, the Pope interfered: on 22 Apr he announced that he had reserved to himself the power hâc vice of providing a successor to Walter Stapeldon. Godwin has unfairly represented this interference, and takes occasion to vituperate the Holy See: nay, goes so far as to attribute the premature death of the consecrating primate, and of the new Bishop, to the terrors excited by the acerbity of the Pope's language. How wide this is from the truth must be evident from the bull addressed to James Berkley, at the date above mentioned, which is fortunately preserved in Bishop Grandisson's 'Register' (vol. i. fol. 35). With great good sense and feeling, after affirming his right to provision, in this particular case of reserve, he excuses the parties on the ground of their being ignorant of his intention, ratifies his election and consecration, supplies every defect, and commands that no prejudice shall accrue, and no obstacle be interposed to the canonical government of his diocese of Exeter.

Notes: James De Berkeley, 6th Lord Berkeley (1st Lord Berkeley), known as "The Just", male heir to his uncle Thomas De Berkeley; and inheriting, by virtue of a special entail and fine, the castle and lordship of Berkeley, with other lords in the said fine specified, was summoned as Baron Berkeley to parliament from Oct 9, 1421 to May 23, 1461. Knighted May 19, 1426. According to the Berkeley family pedigree obtained at Berkeley Castle, he was the 11th Baron by tenure and the 1st Baron by Writ, 1394-1463. Thomas the Magnificent, Lord Berkeley, left a solitary daughter, Elizabeth, who married the powerful Richard Beauchamp, Earl of Warwick, and guardian of Henry VI. They had three daughters. The eldest, Margaret, married the feared John Talbot, Earl of Shrewsbury, the youngest married Richard Neville, later Earl of Warwick. During the long dispute over ownership of the Berkeley estate, Isabel Mowbray, James' wife, was captured by the Countess of Shrewsbury and died in 1452 in prison in Gloucester. James promptly remarried the daughter of the Earl of Shrewsbury. The family dispute is claimed to be the longest dispute in English legal history. During this period the village of Berkeley was burned down twice - once by each side - for 'supporting the enemy', i.e. paying them rent. The life of ordinary people during this time must have been hard indeed. The dispute was eventually resolved by open battle.

Notes: justice of the King's Bench in the reign of King Charles I. He was a staunch Royalist, and was one of the judges at the Ship Money trials, where several Members of Parliament, including John Hampden, were fined or imprisoned for refusing to pay the illegal tax. Sir Robert stated that "Rex was Lex", that the King was "a living breathing law". The divine right of Kings was just about to become an unfashionable idea in England - the English Civil War was upon us. The judgement was overturned, and the Judge himself was arrested when presiding in Court. He was reputedly dragged from the Bench by the Usher of the Black Rod, and thrown in the Tower of London. Whilst on bail awaiting trial, there was a chronic shortage of Judges, so he was allowed to practice until his own trial. He was fined an astonishing £10,000 and deprived of ever holding public office. He went into retirement on his estate at Spetchley near Worcester. In 1651 his house was requisitioned by Cromwell prior to the battle of Worcester. His town house in Worcester, now known as Charles' House, was used by King Charles II to make his escape prior to his famous night spent sleeping in the branches of an oak tree. Sir Robert's house at Spetchley was subsequently burned down by a retreating band of Scottish Presbyterians. Sir Robert ended his days living in the stable block - all that remained of his manor house - and died there in 1656. His descendants still live at Spetchley Park, whose gardens are open to the public.

Notes: accumulated many riches and honours. Of his inheritance from his mother's family he gave over 50 manors to King Henry VII. William was challenged to battle by Viscount Lisle, heir of the Earl of Shrewsbury. In the last battle between private hosts on English soil, the battle of Nibbley Green, the Viscount was defeated and killed by William's superior forces, including archers from the forest of Dean. William's forces rode at once to Wooton, to sack the place. The Viscount's widow promptly miscarried, and so the direct Talbot line ended. This finally ended the dispute between the two families. William became Lord Berkeley, Earl Marshal of England, Earl of Nottingham, Viscount Dursley, Marquis of Berkeley, and probably lots of other things as well. He outlived his three children, but then disinherited his brother because he had "married beneath him"; an Alderman's daughter named Isabel Meade. He left Berkeley Castle and its estates to the crown for 'entail male', which meant that only with the extinction of the Royal male line on the death of King Edward VI did the Castle revert once more to the Berkeley line. Given the events surrounding the end of the Plantagenet line, and the start of the Tudors, with Henry VII's victory at Bosworth, and his subsequent ruthless purging of all those who stood in his way, it would not be surprising to find that William found himself with little choice but to make over the bulk of his wealth to the King's line.

Notes: the late lord's brother, now stripped of the ancient honours and possessions of his forefathers, (though he continued through his life to be styled by courtesy lord Berkeley,) resided, as has been stated, at Thornbury, where, of his own and his wife's, he had a fair estate. As soon as the inquisitions after his brother's death were returned into Chancery, Maurice commenced proceedings to recover from the Crown some of the manors which the Marquess had given away, being advised that such alienations were illegal, and contrary to some old settlements and entails. In these litigations he was generally successful, the late Marquess, in his anxiety to barter his lands for honours and patronage, having often overlooked the nature of the titles by which he held them. Maurice's first success was the recovery of the manor of Sages in Slimbridge, consisting of seven tenements and 290 acres of land, and he entered into possession and held his first court there in 1499. Many other similar suits followed, with the like success, and while these were going on the manor and borough of Tetbury, and several others. descended to him as one of the heirs of the lord Breouse. In 1505 he claimed and recovered the advowson of the Church of Wotton-under-Edge, but immediately made it over to the Abbey of Tewkesbury. He also commenced a suit to recover the advowson of Slimbridge, held by Magdalen College, Oxford, which was settled by a compromise. The College retaining the advowson but paying him a sum of money, and undertaking to remember him in their prayers. In his journeys to and from London, and when visiting his manor of Callowden, near Coventry, finding that he and his suite were not received at the Monastery of Combe, in Warwickshire, with the honour and respect due to him as descendant from one of its founders, Maurice exhibited a bill in Chancery against the Abbot and Monks, claiming his rights in respect of his descent from Thomas Mowbray, Duke of Norfolk, their founder, and obtained an acknowledgement of his claim. Maurice died in 1506, and was buried in the Church of the Augustine Friars, in London. His eldest son, Maurice, succeeded him.
